Lewdness Involving Child
Lewdness (sometime called indecent exposure) involving a child is a serious offense, and includes the following behavior:
- Performing a sex act in the presence of a child
- Exposing one’s private parts in the presence of a child
If these behaviors were done either (1) under circumstances you knew would likely cause alarm, or (2) with intent to arouse or gratify sexual desires, then you could be charged with a crime. In Utah, lewdness involving a child is either a class A misdemeanor (if this is your first time and your’re not already on a sex-offender registry list) or a third-degree felony. In addition to criminal sanctions, the public humiliation of this type of conviction is severe.
